In-country employment in Hong Kong

Hong Kong is often a first regional seat: a country manager, a finance lead, or a commercial hire covering Greater China.

The statutory stack is lighter than the mainland — MPF rather than city social insurance — but the Employment Ordinance, the statutory minimum wage, and employees' compensation insurance still apply from day one.

In-country employment vs incorporating

Incorporating in Hong Kong is relatively fast. In-country employment is still the usual path for a single seat, a bridge hire, or a team that should not wait on company setup.

Onboarding

From briefing to first payday

MPF enrolment has a statutory window. Document collection, not incorporation, is usually the wait.

Enrol MPF and put employees' compensation insurance in place.

Compliance

Five points that change the hire

  1. 01

    Statutory minimum wage is hourly

From 1 May 2026 the rate is HK$43.1 an hour. It is not a monthly salary floor.

  2. 02

    MPF enrolment

Enrol an eligible employee in an MPF scheme within the statutory period from the start of employment. The employer still contributes below the minimum relevant-income level.

  3. 03

    Employees' compensation insurance

Mandatory. A contract without cover is not a complete hire.

  4. 04

No 13th month in the Ordinance

A year-end bonus is contractual if you put it in the offer. Do not assume it is implied.

  5. 05

Visa if they are not free to work

Hong Kong residents and specified status holders can start. Others need an immigration permission that matches the job.

Questions

FAQ

Can we hire in Hong Kong without a Hong Kong company?
Yes, through in-country employment: a licensed local employer holds the Employment Ordinance contract, enrols MPF, and runs payroll, while your managers direct the work.
What is the Hong Kong minimum wage in 2026?
HK$43.1 per hour from 1 May 2026, under the Minimum Wage Ordinance. It is an hourly rate, not a monthly salary.
How much is MPF?
Employer and employee each pay 5% of relevant income, capped at HK$1,500 a month on the current HK$30,000 relevant-income cap. Employees below HK$7,100 relevant income do not contribute; the employer still does.
Is there a statutory 13th month in Hong Kong?
No. If you want a year-end payment, write it into the contract. Custom is not a substitute for a clause.
